The Victorian Law Reform Commission has released a consultation paper on jury empanelment and is seeking submissions by 15 November 2013.
The Attorney-General has asked the Commission to consider three aspects of the jury empanelment process for both criminal and civil trials:
- peremptory challenges and the Crown right in criminal trials to stand jurors aside
- whether jurors should be identified by name or number in court
- the process for balloting off additional jurors.
The Commission has been asked in particular to consider the effects of these processes on jurors.
During October and November, the Victorian Law Reform Commission will consult with people who have been involved in jury selection in regional Victoria and Melbourne.
An online survey is available for jurors to provide information about their experiences.
