Victims of Crime Assistance Act 1996

On 7 July 2017 pursuant to section 5(2)(a) of the Victorian Law Reform Commission Act 2000, the Attorney-General, the Hon. Martin Pakula MP, provided the Victorian Law Reform Commission with supplementary terms of reference for the review on family violence and the Victims of Crime Assistance Act 1996 (the Act). 

The supplementary terms of reference are additional to the terms of reference provided by the Attorney-General on 22 December 2016. 

The supplementary terms of reference ask the Commission to expand the first reference to consider the operation and effectiveness of the Act and the Victims of Crime Assistance Tribunal (VOCAT) for all victims, including family violence victims.

Consultation

The Commission prepared a consultation paper responding to the first terms of reference, Family Violence and the Victims of Crime Assistance Act 1996, along with a public call for submissions. This first consultation paper relates only to the operation of the Act for family violence victims. 

The Commission has also prepared a supplementary consultation paper responding to the supplementary terms of reference. The Review of the Victims of Crime Assistance Act 1996 supplementary consultation paper relates to the operation of the Act for all victims of crime. Submissions have closed. 

A single report addressing both the first and supplementary terms of reference will be provided to the Attorney-General by 27 July 2018.
