Family Violence Police Holding Powers: Interim Report
The commission published the Family Violence Police Holding Powers: Interim Report on 15 September 2005.
The interim report recommends:
- police should have holding (detention) powers in family violence situations
- police may use such force as is reasonably necessary to detain the perpetrator
- perpetrators of family violence may only be held while a complaint or intervention order is applied for and served, police are putting in place measures to protect victim/s, and the complaint or intervention order is refused
- police may not hold perpetrators for longer than 6 hours
- police may only hold people aged 18 years or older
- police guidelines on dealing with family violence in newly arrived migrant communities.
