Forfeiture Rule: consultation paper (pdf)

The Victorian Law Reform Commission has been asked to review the common law rule of forfeiture and the circumstances in which it should not be appropriate for a person who has killed another to benefit from that death, including by way of survivorship or as a beneficiary under a will or under intestacy rules.

The terms of reference require the Commission to consider a number of particular matters including the existing exception to the forfeiture rule where a person is found not guilty of a killing because of mental impairment.

This consultation paper provides background information on the issues, including the approaches and legislative development in other jurisdictions, and asks a number of questions. Submissions close on 28 April 2014.

The Commission is to report no later than 15 September 2014.
