The Victorian Law Reform Commission has been asked to review the common law rule of forfeiture and the circumstances in which it should not be appropriate for a person who has killed another to benefit from that death, including by way of survivorship or as a beneficiary under a will or under intestacy rules.
The terms of reference require the Commission to consider a number of particular matters including the existing exception to the forfeiture rule where a person is found not guilty of a killing because of mental impairment. Read more about Forfeiture Rule: consultation paper (html version)
