Review of Serious Driving Offences announced
The Victorian Law Reform Commission will review the law on serious driving offences in Victoria.
The Attorney-General, the Hon. Sonya Kilkenny, has asked the Commission to review the adequacy of the current serious driving offences laws and whether they are fit for purpose.
As part of the review, the Commission will consider a range of matters including:
- whether the current serious driving offences appropriately criminalise the range of driving conduct that causes serious injury or death
- whether the elements of the offence are well understood, clear and distinguishable
- sentencing practices and available sentencing options for serious driving offences, including whether they are in line with community expectations
- how the serious driving offences framework could be strengthened to promote offender responsibility, including potential new offences for negligent driving that causes death or serious injury.
As part of the review, the Commission will call for submissions and undertake community consultation to inform its final report and recommendations.
The Commission will deliver its report to the Attorney-General by 31 March 2028
